    Phase 1 and ELT

    Need a definitive answer as to whether a ELT is required to be installed for Phase 1 flight testing and to receive an Airworthiness Certificate.

    Go see FAR 91.207 (f) (4) and/or (9). I think that puts your answer at NO.

    You might also post this question on the VAF Forum. One of the frequent posters there is a DAR who writes a column for Kitplanes magazine and frequently comments on a DAR's perspective on questions regarding aircraft registration.

    As for flying Phase I without an ELT, Title 14 of the CFRs 91.207 (f) (4) says that you don't need an ELT for operations incident to design and testing.

    This has been a topic of discussion in many DAR meetings with FAA advisors. Yes, the regulation clearly states that and ELT is not required for flight testing. However, most FAA inspectors and many DARs want to see the ELT mounting location and inspect for security and proper operation during the initial airworthiness inspection. So, it comes down to this; when the FAA inspector or DAR says he/she wants the ELT installed during the initial airworthiness inspection, do you want to go toe to toe with the inspector and argue about whether it's required for phase 1 flight testing or not, or do you want to get the inspection done with a minimal amount of angst. Your choice!!
